HealthyGene PLLC (“HealthyGene”) understands that information about your healthcare and yourself is personal. HealthyGene is committed to protecting your health information.
HealthyGene creates a record of the care and services you receive from HealthyGene, which is needed to provide quality care and to comply with certain legal requirements. These practices apply to all of the records of your care generated by HealthyGene and explain the ways in which HealthyGene may use and disclose health information about you. These practices also describe your rights to the health information HealthyGene keeps about you and certain obligations HealthyGene has regarding the use and disclosure of your health information.

HealthyGene typically uses your protected health information in the following ways:

Services: HealthyGene may disclose your PHI for services provided by HealthyGene and the activities of any health care provider you have authorized to receive such information.

Payment: HealthyGene may disclose PHI for payment. For example, listing the provided services on our invoices for payment.

Health Care Operations: HealthyGene may use your PHI for operational purposes, such as appointment reminders, to evaluate the performance of HealthyGene’s staff, assess the quality of services and outcomes, train employees, and learn how to improve HealthyGene’s services.

For law enforcement purposes, including reporting crimes occurring on HealthyGene’s premises.

To coroners or medical examiners, when such individuals are performing duties authorized by law.

For research purposes, including for research recruitment purposes to determine your eligibility for research studies conducted by HealthyGene or other entities. We may also use de-identified information in aggregate in various research efforts.

Specialized government functions, such as military, national security, and presidential protective services; or, helping to ensure the safety of those in correctional institutions.

Appointment reminders and health related benefits or services. HealthyGene may use and disclose your PHI to contact you to remind you that you have an appointment with HealthyGene. HealthyGene may also use and disclose your PHI to tell you about treatment alternatives, or other health care services or benefits that HealthyGene offers.

HealthyGene may also provide your PHI to a family member, friend, or other person that you indicate is involved in your care or the payment for your health care, however, you will have the opportunity to object (in whole or in part). The opportunity to consent may be obtained retroactively in emergency situations.

When required by the Secretary of the Department of Health and Human Services to investigate or determine our compliance with the requirements of Section 164.500, et seq.
You have the following rights with respect to your PHI:

The Right to Request Limits. You have the right to ask HealthyGene not to use or disclose certain PHI for treatment, payment, or health care operations purposes. HealthyGene is not required to agree to your request, and HealthyGene may say “no” if HealthyGene believes it would affect your health care.

The Right to Request Restrictions for Paid Out-of-Pocket Expenses. You have the right to request restrictions on disclosures of PHI to health plans for payment or health care operations purposes if the PHI pertains solely to a health care item or a health care service that you have paid for out-of-pocket in full.

The Right to Choose How HealthyGene Sends PHI to You. You have the right to ask HealthyGene to contact you in a specific way (for example, home or office phone) or to send mail to a different address, and HealthyGene will agree to all reasonable requests.

The Right to See and Get Copies of Your PHI. You have the right to get an electronic or paper copy of your medical record and other information that HealthyGene has about you. HealthyGene will provide you with a copy of your record, or a summary of it, if you agree to receive a summary, within 30 days of receiving your written request. HealthyGene may charge a reasonable, cost-based fee for doing so.

The Right to Get a List of the Disclosures HealthyGene Has Made. You have the right to request a list of instances in which HealthyGene has disclosed your PHI for purposes other than treatment, payment, or health care operations, or for which you provided HealthyGene with an Authorization. HealthyGene will respond to your request for an accounting of disclosures within 60 days of receiving your request. The list HealthyGene will give you will include disclosures made in the last six years unless you request a shorter time. HealthyGene will provide the list to you at no charge, but if you make more than one request in the same year, HealthyGene will charge you a reasonable cost-based fee for each additional request.

The Right to Correct or Update your PHI. If you believe that there is a mistake in your PHI, or that a piece of important information is missing from your PHI, you have the right to request that HealthyGene correct the information or add the missing information. HealthyGene may say “no” but will tell you why in writing within 60 days of receiving your request.

The Right to Get a Paper or Electronic Copy of this Acknowledgement. You have the right get a paper and/or email copy of this Acknowledgement and to request a paper copy at any time.

Right to be Notified of a Breach. You have the right to be notified if HealthyGene or a business associate of HealthyGene discovers a breach of unsecured protected health information.

The Right to Choose Someone to Act for You. Someone with medical power of attorney or a legal guardian can exercise your rights and make choices about your health information.

File a Complaint if You Feel Your Privacy Rights Have Been Violated. You can do so by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. HealthyGene will not retaliate against you for filing a complaint.

Illinois Law. Illinois law also has certain requirements that govern the use or disclosure of your PHI. For HealthyGene to release information about mental health treatment, genetic information, your AIDS/HIV status, and alcohol or drug abuse treatment, you will be required to sign an authorization form unless state law allows HealthyGene to make the specific type of use or disclosure without a separate authorization.
